Because permanent mangekyou doesn't mean you have to have it on all the time, it merely means you don't lose your eyesight to the ability. You also gain an additional technique. But since it would still require chakra to do anything even with a permanent Mangekyou having it on at every moment would be pointless.

The point is that there's no set "good and evil" - I think it makes sense how Itachi could be good and evil at the same time. Good in heart, yet he did commit evil deeds. But honestly I hope the next manga comes out soon, so that we can make more sense about how his motives were good. Just because Madara says that he was good doesn't mean he was. He never said that Itachi didn't kill off the rest of the clan, he did affirm that he helped Itachi wipe them out, good intentions or not.
