As someone who lives in NY and has had my bike fucked up by an SUV I have to disagree. Losing your bike really fucks you up if you rely on it for work or commuting.

went to court for what? the messenger tried to overtake the van in the inside, on the same lane. it's a van without windows and the side is a deadspot in the mirror, no way the van driver could have seen him. and even if (he was allready past the side window) to me it looks life the messenger pulled into the van, trieing to change lane and cutting him of, and not the other way around. and as goes for the running over the bike twice when pulling to the side... yeah, that was stupid
